Acceptance of Terms

These Terms of Service ("Terms") cover this website, riverling.app, and nothing else. By using the site you agree to them. If you do not agree with them, do not use the site.

riverling is made by one person. These Terms are an agreement between you and Alexander Moss, an individual, who publishes this website. "We" and "us" throughout this page mean Alexander Moss.

The App Is Not Covered by These Terms

The riverling app is licensed to you by Apple's standard Licensed Application End User License Agreement, which you accept through the App Store. That is the agreement governing the app: what you may install it on, what you may not do to it, and the warranty and liability terms that come with it. It is deliberately Apple's rather than ours.

So nothing on this page applies to the app. These Terms are about a website: some pages describing a game, and the links on them. If you are looking for the terms attached to the software, they are in Apple's agreement, not here. What the app does with data is a separate question again, answered in the privacy notice.

What This Site Is

riverling.app is a small set of static pages: a description of the game, a support page, a privacy notice, and this one. It is free to read, and there is nothing on it to buy, sign up for, or log in to.

We may change the site, restructure it, or take it down. Nothing here promises that any page will still be at the same address later.

No Accounts

The site has no accounts. There is nothing to register for, no credentials to create, no profile, and no comment box. There is nothing for us to suspend, because there is nothing to hold.

Age Requirements

The site sets no minimum age. It is a few pages of text about a game rated 4+, and it asks nothing of a reader that a child could not do.

We can say that plainly because the site collects no personal information from anyone, child or adult. There is no sign-up, no analytics, and nothing to submit, so there is no age threshold to enforce and no parental consent for us to obtain. The privacy notice covers this in full, for the app as well as the site.

Intellectual Property

This site, its text, and its images are the property of Alexander Moss. The riverling name and its look may not be used for another product or service without our written permission.

Quoting a sentence or two with a link back is fine and needs no permission. Reposting a page wholesale is not.

Prohibited Uses

Most of the usual list does not apply to a static site with no accounts and no submission forms. What is left is short. You agree not to:

Disclaimer of Warranties

The site is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise it will be reachable, current, or free of errors.

Some places do not allow these exclusions. Where that is so, this section applies to you only as far as the law there allows.

Limitation of Liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, this website. Our total liability to you for any claim relating to the site is capped at one hundred dollars ($100).

Nothing here limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence. Some places do not allow the exclusion of incidental or consequential damages; where that is so, the paragraph above applies only as far as the law there allows.

Links to Other Sites

This site links outward: to Apple, to the beta, and from the privacy notice to a handful of data protection regulators. We do not control any of them and are not responsible for what they do or say. Their terms are their own.

Governing Law

These Terms are governed by the laws of the State of Alabama, USA, without regard to its conflict of law rules. Disputes arising under them will be heard in the state or federal courts located in Alabama.

There is no arbitration clause here and no class action waiver, and that is deliberate. If you live somewhere that gives you consumer rights which cannot be signed away, you keep them, and you may be able to bring a claim where you live instead.

General

If any part of these Terms is unenforceable, the rest stays in force. If we do not enforce something straight away, we have not given up the right to enforce it later. You may not transfer these Terms to anyone else. We may transfer them if riverling changes hands, and the same terms would follow. These Terms and the privacy notice are the whole agreement between us about this website.

Changes to Terms

We may change these Terms. Material changes will be posted on this page with a new date at the top. Using the site after a change means you accept the revised Terms.
